Selling PS3s on eBay – illegal and/or unethical

According to this great article at PS3 Fanboy, selling PS3s at higher prices on eBay is both illegal and unethical.

First, the legal aspect: Think about ticket scalpers – those who resell tickets to events at higher prices. It’s illegal. Sure, we can argue all day about how people have a right to make money any way they want, and we can argue that as long as eBay allows the auctions, they’re legal. But according to the precedent that ticket scalping sets, it’s illegal to sell the PS3s at a huge markup.

Next, the ethical aspect. It’s unethical to buy the console with the sole intention of profiting heavily by taking advantage of people desperate to get the console. Once again, we can argue for days about how anyone who’s willing to pay the money to get the console sooner is not being taken advantage of. After all, the console is not a life-or-death item, and if people are willing to pay more to have it NOW, let them.

In other industries, with other products, would the manufacturers put a stop to these sorts of auctions? I don’t know. Do Sony and Microsoft allow them just for the publicity – so they can say “look how much people are willing to pay for our hardware?” I don’t know. What do you think?

Arguments aside, PS3 Fanboy has settled the issue for us, once and for all. *snort*

    Actually it is no way illegal, it might be a bit immoral, but illegal it is not. Reselling merchandise for twice the price is perfectly legal, ticket sales fall under a different category (why I dont know) and they fall under different laws. If you want a PS3 bad enough you could have been in line.

    This is completely unethical and should be illegal. You’re basically taking advantage of the guy who was one place behind you in line and didn’t get a pre-order. It’s unfair to those who actually want a system. That makes you no better than the car dealer who tries to rip you off with a bad car or an insurance salesman that lies to you so you’ll buy insurance you don’t need. In fact you’re as loathsome as cell phone companies.
    At the very least you should be required to start your auction at the sale price of the system or less. You shouldn’t be able to start an auction at hundreds more than what you paid for it. THAT should definitely be illegal.

    Why do people have a problem with someone buying a product at a price and then selling it at a higher price in order to make a profit. Are they not aware this is what all retailers do? Why should it be unethical when it is done by an individual. As for the prices being way more than what is paid, it is called supply and demand, people.
