EB Cancelling PS3 Pre-orders That Appear On eBay

So far this is only listed as happening in Canada, but EB Games employees are collecting info on all PS3 pre-orders that appear on eBay and are sending the lists to their stores, who are to cancel those PS3 pre-orders. Sony and eBay are in on this too – they’re helping EB with the endeavor. Since eBay is requiring scans/photos of the receipts for pre-orders, it’s simple to do. Will this actually help cut down, at least a little, on the exorbitant eBay prices?

    Has anyone explored the legal ramifications of ebay’s actions here? If they are in fact “in on it” as this article and several others I’ve read seem to imply, then they could be subject to a large class action lawsuit from anyone who lists a preorder that gets cancelled. Think about it – Ebay keeps the fees for the listing regardless of what happens to your product after the fact. So, if they’re in league with EB on this, then they are intentionally setting their customers up for failure. The seller loses their money – invalid preorder = angry buyer. Ebay, however, would be keeping all transaction fees because they did their part so to speak, in that they allowed the seller to list the item.

    Now this is all based on the speculation that ebay is, in fact, in on it with EB. If ebay came up with the idea to require a pic of the receipt on their own (or at least if they can make it look that way in court) then the ebay seller is the real loser here.
